Application for Pesticide Permit
Under the Pesticides Ordinance (Cap.133), only person holding a valid permit may import, supply, manufacture, sell, possess or use any scheduled or unregistered pesticide; or export or transship any scheduled pesticide. Any person may apply, in the following manner, for a permit:

Application for a permit may be made at Agriculture, Fisheries and Conservation Department, 5/F., Cheung Sha Wan Government Offices, 303 Cheung Sha Wan Road, Kowloon.

Postal application should be addressed to the Director but enquiries may be made directly to the Plant and Pesticides Regulatory Division at Tel.: (852) 2150 7008.

Applicants are required to complete the application form in duplicate. A photocopy of the Business Registration Certificate should be submitted together with the application.

Processing the application will demand 2-4 working days .

Before the application can be accepted for consideration, every item on the application form must be completed. Also it must be accompanied with a receipt of a non-refundable application fee of HK$180.00.

an inspection of the premises used for storage, manufacture, reformulation etc. to be carried out;

special labeling requirement of the containers be observed;
-
specification and marking of the target plants/pests be provided;

permittee to notify AFCD the persons or organizations who will use or be supplied with the unregistered pesticide;

permittee to acquire and use appropriate protective clothing;

permittee to guarantee the supply of antidote if applicable; and
-
other conditions appropriate to the case be set to the permit.

Where the application is approved, the applicant will be notified and one of the following fees is required before the permit can be issued.

to import and re-export scheduled or unregistered pesticide without repackaging HK$ 805.00

for other purposes HK$ 1,470.00

If this fee is not paid within 1 month counting from the date of issuance of notification of approval, the approval will lapse and a new application must be made.

All permits expire 6 months after the date of issue and the pesticide must be imported within this period. The permittee may apply for permit extension one month before the permit expiry date to the Director of Agriculture, Fisheries and Conservation for an extension for a further period of 6 months. The non-refundable extension fees are charged depending on the following categories:

to import and re-export scheduled or unregistered pesticide without repackaging HK$ 435.00

for other purposes HK$ 1,050.00

The pesticide may only be used for the purposes specified in the permit and under the conditions specified.

Penalties for Dealing with Scheduled or Unregistered Pesticides Illegally:
- maximum fine at level 5 and 1 year imprisonment.
(i) use of any prohibited or controlled inert ingredient without a permit in the manufacture of pesticides. (ii) import / sale / supply of pesticides containing any prohibited or controlled inert ingredient.
- maximum fine at level 1 and 6 months imprisonment.
- maximum fine at level 4 and 6 months imprisonment.
